What Happened
Children placed in foster care are among the most vulnerable in our society, and the agencies and individuals responsible for their care have a legal duty to keep them safe. When foster parents, group home staff, caseworkers, or other caregivers commit acts of abuse, neglect, or exploitation, the agencies and institutions that placed and supervised those children may be held legally accountable.
Investigations across California have revealed systemic failures in the foster care system — inadequate background checks, insufficient oversight of placements, and failures to act on reports of abuse. Survivors who experienced harm in foster care placements, group homes, or other out-of-home care settings have the right to pursue justice and seek compensation, regardless of how long ago the abuse occurred.
Who May Qualify
You may be eligible to be connected with a participating law firm if you or a loved one experienced any of the following while in foster care or out-of-home placement in California:
- Physical, sexual, or emotional abuse by a foster parent, caregiver, or household member
- Neglect, including failure to provide adequate food, shelter, medical care, or supervision
- Abuse by another child in the placement that caregivers failed to prevent
- Abuse that was reported to a caseworker or agency but ignored or not properly investigated
- Harm that occurred in a licensed foster home, group home, residential facility, or kinship placement
- Lasting psychological, emotional, or physical harm resulting from the abuse or neglect
Types of Losses Attorneys May Evaluate
Pain & Suffering
Compensation sought for the profound physical and emotional pain caused by the abuse, including trauma experienced both at the time and in the years that followed.
Psychological Harm
Claims for lasting mental health impacts including PTSD, depression, anxiety, and other conditions requiring ongoing treatment and therapy.
Medical & Therapy Costs
Past and future expenses related to mental health treatment, counseling, psychiatric care, and other medical costs resulting from the abuse.
Lost Earning Capacity
The impact the abuse has had on your ability to work, maintain employment, or reach your full earning potential.
Loss of Enjoyment of Life
The ways in which the abuse has diminished your ability to experience relationships, opportunities, and quality of life.
Punitive Damages
In cases of egregious institutional negligence or deliberate cover-up, courts may award additional punitive damages to hold responsible agencies accountable. Whether punitive damages apply depends on the specific facts of each case.
